Expert Work in Forensic Delay Analysis

1. Introduction

With over 30 years of experience in project delivery and 21 years focused on international dispute resolution, I act as an independent expert witness on matters of time, delay, and disruption. I provide the forensic clarity and technical authority needed to assist tribunals in navigating complex construction disputes across a range of sectors, including infrastructure, energy, oil & gas, and major building projects.

2. My Duty to the Tribunal

I recognise that my primary duty as an expert witness is to the tribunal, providing an independent and unbiased opinion that is objective and evidence-led. Whether appointed by a claimant, respondent, or as a single joint expert, I maintain a strict focus on technical truth. My goal is to translate dense project data into a clear, forensic narrative that stands up to the most rigorous cross-examination.

3. Expert Witness Services

I offer a range of specialist services designed to support formal dispute resolution processes:

  • Expert Reports (Party Appointed or SJE): I produce comprehensive, CPR-compliant reports (or international equivalent) that clearly articulate findings on delay, disruption, and concurrency.

  • Joint Statements & Expert Meetings: I work professionally with opposing experts to narrow the issues in dispute, identifying areas of agreement and providing a clear technical basis for any remaining disagreements.

  • Oral Testimony & Cross-Examination: I have decades of experience giving evidence in international arbitrations, providing calm, authoritative testimony that assists the tribunal in its determination.

  • Concurrent Evidence ('Hot-Tubbing'): I am highly experienced in providing evidence through concurrent sessions, engaging in high-level technical dialogue to find common ground on complex programme issues.

  • Technical Advisory for Counsel: I assist legal teams by reviewing opposing expert evidence and providing technical 'shadow' support to identify flaws in forensic methodologies.

4. Expert Methodology in Support of Tribunal Duties

My expert opinions are grounded in recognised delay-analysis principles and in the contemporaneous project record. However, the purpose of expert work is not to rehearse every available method in abstract terms; it is to apply the most appropriate methodology to the issues the tribunal must decide.

I therefore select and explain the analytical approach in a way that is proportionate to the records, the pleaded issues, and the procedural context of the case. The emphasis is always on independence, transparency of reasoning, and assisting the tribunal with conclusions it can properly test and rely upon.

5. Technology in Support of Tribunal Clarity

In expert work, the challenge is not simply analysing data; it is presenting it in a form that is reliable, proportionate, and intelligible to a tribunal. I use structured digital review methods to sift large project records efficiently and to isolate the issues that genuinely matter to the expert opinion.

This allows me to reduce unnecessary complexity, test competing narratives against the contemporaneous record, and present conclusions in a way that assists the tribunal rather than overwhelms it. The emphasis is always on independence, proportionality, and clarity of expert reasoning.

6. A Testifying Expert’s Perspective

What sets my work apart is the combination of academic depth—evidenced by my PhD in Collaborative Contracts and Risk—and the practical experience of having led major projects on the ground. Because I have spent over 20 years in the witness box, I know that a persuasive expert opinion is not just about the math; it is about the ability to explain complex technical logic with absolute clarity. I bring the forensic rigour and senior-level authority needed to protect the integrity of the evidence and the reputation of my clients.

7. Independent Expert Evidence Built on Forensic Discipline

Independent expert evidence is strongest when it rests on disciplined analysis, clear reasoning, and an objective reading of the contemporaneous record. My role is to assist tribunals with opinions that are technically rigorous, balanced, and properly explained.
